The Spanish framework
Article 25 of Regulation (EU) 910/2014 says an electronic signature is not denied legal effect solely because it is electronic. Article 3 of Ley 6/2020 says electronic public, administrative, and private documents have the legal value and efficacy that correspond to their nature, under the law that applies to them. inSigner keeps acceptance of its process, attribution, and the completion record. It does not decide which form a document needs.

For many commercial agreements, yes. Article 25 of Regulation (EU) 910/2014, which applies in Spain, says an electronic signature is not denied legal effect, or admissibility as evidence, solely because it is electronic. Article 3 of Ley 6/2020 says electronic public, administrative, and private documents have the legal value and efficacy that correspond to their nature, under the law that applies to them. Where that law does not require a special form, a simple electronic signature can be used. The standard inSigner signature is a simple electronic signature. Its effect still depends on the document.
Article 3.1 says those documents have the legal value and efficacy that correspond to their nature, in accordance with the legislation that applies to them. Article 3.2 says proof of a private electronic document that used a non-qualified trust service follows article 326.3 of Ley 1/2000, the Civil Procedure Act. If the trust service is qualified, article 326.4 of the same act applies. Article 1 says Ley 6/2020 regulates certain aspects of electronic trust services as a complement to Regulation (EU) 910/2014, and the act does not restate the regulation. The standard inSigner signature is not a qualified electronic signature, and it is not a qualified trust service. Counsel decides which rule applies.

No. A qualified electronic signature uses a qualified certificate from a qualified trust service provider, and under eIDAS it has the effect of a handwritten signature. The standard inSigner signature is a simple electronic signature. Qualified signatures for Europe, and the AATL check, are Enterprise options. They are not on Essential or Pro. Ley 6/2020 does not turn the standard signature into a qualified one.
No. Article 3 ties the value of an electronic document to its nature and to the law that applies. A public deed is a notarial act. inSigner does not notarize a document, and it does not file documents with the Registro de la Propiedad or the Registro Mercantil. The derogatory provision of Ley 6/2020 repeals Ley 59/2003, the earlier electronic signature act. That repeal does not mean every document can be signed here.
No. For the documents you send, you are the controller and Nubesti is the processor under the data processing agreement, which includes the EU Standard Contractual Clauses. The GDPR applies in Spain. inSigner does not decide whether your workflow meets it, and it does not write your notices or choose your lawful basis. Nubesti is the controller for the account, billing, security, support, and marketing.
