Are electronic signatures legal in Germany?

For many commercial agreements, yes. Article 25 of Regulation (EU) 910/2014, which applies in Germany, says an electronic signature is not denied legal effect, or admissibility as evidence, solely because it is electronic. Where no statute requires a form, a simple electronic signature can be used. The standard inSigner signature is a simple electronic signature. Its effect still depends on the document. If a statute requires written form, §126a BGB requires a qualified electronic signature to replace it, unless another statute provides otherwise.

What does §126a BGB require?

Section 126a says that, where statutory written form is replaced by electronic form, the person making the statement must add their name and sign the electronic document with a qualified electronic signature. For a contract, each party must sign an identical document that way. Section 126(3) allows electronic form to replace written form unless another statute provides otherwise. The standard inSigner signature is not a qualified electronic signature, so it does not meet §126a. Where the parties agree on electronic form, §127(3) says that, unless a different intention appears, an electronic signature other than the qualified signature in §126a can suffice. Counsel decides which rule applies.

How does the record show who signed and what they signed?

Each person signs the fields you placed in the document you sent. The evidence record keeps their name and email address or phone number, when the document was sent, viewed, and signed, the IP address and device details, and the authentication used.

Can I download evidence for a completed document?

Yes. You can download the completed PDF and the evidence record, including a SHA-256 hash of the final file. If a single byte changes, the hash no longer matches.

Is the standard signature a qualified electronic signature under §126a BGB?

No. A qualified electronic signature uses a qualified certificate from a qualified trust service provider, and under eIDAS it has the effect of a handwritten signature. The standard inSigner signature is a simple electronic signature. Qualified signatures for Europe, and the AATL check, are Enterprise options. They are not on Essential or Pro.

Can every document in Germany go through inSigner?

No. Section 623 BGB requires written form to end an employment relationship by notice or by a termination agreement, and it excludes electronic form. A qualified signature does not satisfy that section either, because electronic form is excluded. A notarial recording is a separate act. inSigner does not notarize a document, and it does not file documents with the Handelsregister or the Grundbuch.

Does inSigner make our workflow GDPR compliant?

No. For the documents you send, you are the controller and Nubesti is the processor under the data processing agreement, which includes the EU Standard Contractual Clauses. The GDPR applies in Germany. inSigner does not decide whether your workflow meets it, and it does not write your notices or choose your lawful basis. Nubesti is the controller for the account, billing, security, support, and marketing.

Does inSigner cover clinical consent, account opening, or round-the-clock regulated workflows?

No. This page does not offer patient forms, clinical consent, account opening, or credit agreements as a regulated program. Identity checks such as KYC are add-ons priced separately, not the default. inSigner does not publish an uptime percentage or a public status page, and it does not decide the legal effect of a document.
