Are electronic signatures legal in Costa Rica?

Law 8454 of 30 August 2005, in force from 13 October 2005, on certificates, digital signatures, and electronic documents, sets the current rules. Article 1 applies the Act to public and private transactions unless another law says otherwise, or the nature or particular requirements of the act are incompatible. Article 3 says any representative or declarative statement expressed or transmitted by electronic means is treated as legally equivalent to a document on a physical medium. Using an electronic medium does not waive the formalities the law requires for a given act. Article 8 defines a digital signature and says it is certified when issued under a valid digital certificate from a registered certifier. The standard inSigner signature is not a certified digital signature. Whether a given document is valid still depends on the document and the law that governs it. inSigner does not decide that question.

What does article 8 require for a certified digital signature?

Article 8 defines a digital signature as any set of data attached or logically associated to an electronic document that lets a person verify its integrity and uniquely identify and legally link the author to that document. The second paragraph of article 8 says a digital signature is certified when it is issued under a valid digital certificate from a registered certifier. Article 9 gives documents signed with a digital signature the same value and evidentiary effect as a handwritten signature, and it says a public electronic document must carry a certified digital signature. Article 10 presumes authorship of a document linked to a certified digital signature, unless proven otherwise. Article 18 says only registered certifiers issue certificates with full effect against third parties and the State. The Dirección de Certificadores de Firma Digital sits in MICITT. inSigner is not that office and is not a registered certifier. QES for Europe is an Enterprise option and is not a Costa Rican certified digital signature.

How does the record show who signed what?

Each person signs the fields you placed on the document you sent. The evidence record keeps their name and email or phone, when the document was sent, viewed, and signed, the IP address, the device data, and the authentication used.

Can I download the evidence for a completed document?

Yes. You can download the completed PDF and the evidence record, including a SHA-256 hash of the final file. If a single byte changes, the hash no longer matches. The hash shows whether the final file still matches. It is not a certified digital signature under article 8, and it is not encryption. Article 4 gives electronic documents the same evidentiary force as paper documents of the same class. The hash does not by itself decide that article.

What inSigner does not cover

Is the standard signature a certified digital signature or a QES?

No. Essential and Pro use a simple electronic signature. Article 8 of Law 8454 treats a certified digital signature as one issued under a valid digital certificate from a registered certifier. inSigner is not that certifier. QES for Europe is an Enterprise option, priced separately, and it is not a Costa Rican certified digital signature. It is not on Essential or Pro.

Does article 3 cover a family-law act, a will, or a public electronic document?

No. Article 5 leaves out family-law acts and agreements, highly personal acts, acts that must be fixed on paper, and dispositions mortis causa, with limited later exceptions. Article 9 says a public electronic document must carry a certified digital signature. inSigner does not act as a notary, does not witness a signature, and does not file a document in the National Registry. Your counsel decides the form a document needs.

Does accepting the process satisfy article 3, article 8, or article 9?

Not by itself. Accepting the electronic process in inSigner records consent to sign that document. It does not, by itself, turn the signature into a certified digital signature under article 8, and it does not decide the evidentiary value under article 4 or article 9. inSigner does not decide those points for you.

Does inSigner make a workflow comply with local privacy law, or cover clinical consent and uptime?

No. For the documents you send, you decide the purpose. inSigner does not write your privacy notice and does not make a workflow compliant with Costa Rican privacy or data protection law, including Law 8968. Nubesti handles the account, billing, security, support, and marketing. Do not use the product by default for patient forms, clinical consent, account opening, credit decisions, or KYC. Identity checks are add-ons priced separately. There is no public status page and no uptime percentage. The mobile apps are planned, not a public download.
